1. General
- The Owners of The Nook are
Alex & Helen Reid; binding
contracts can only be made between the Booker and the Owners, or duly authorised agents acting on behalf of the Owners.
- The only authorised agents able to make binding contracts are
Cottage in the Country, and Ms Diane Thomas.
- A binding contract between
the Owners of The Nook and the Booker shall only be entered into upon a
confirmation being issued by the Owners or the above authorised
agents.
- If for any reason any
booking cannot be confirmed, then any deposit or other monies paid will be
refunded in full.
2. Payment
- Bookings will be confirmed
only on receipt of a deposit of 25% of the total rental, or if the booking
is being made within 30 days of the commencement of the holiday, the full
rental.
- The balance of the rental
must be paid to the Owners or their authorised
agents one month (30 days) prior to the commencement of the booking.
- If the balance is not paid
in full one month before the commencement of the booking, the Owners
reserve the right to cancel the booking, in which case the deposit is
forfeit.
- Receipt of a deposit shall
not constitute the confirmation of a booking.
- Payments should be made to
the Owners or authorised agents in accordance
with their normal practice, as advised at the time the booking is
requested.
- Bank charges incurred by
overseas payments will be billed to the Booker.
3. Cancellation
- Any cancellation must be
sent to the Owners or their authorised agents in
writing (including email) and must be made by the person who made the
booking in the first place. The effective date of cancellation will be the
date that the written instructions are received.
- If the booking is
cancelled by the Booker the following cancellation charges will apply:
More than 30 days before the commencement of the holiday – Loss of the
deposit.
Less than 30 days before the commencement of the holiday – Loss of
the full amount paid.
However, if the Owners or their agents are successful in reletting The Nook for the entire period booked, then
a refund will be made, less the deposit paid. The Owners reserve the right,
in their sole discretion, to make a full refund, less administrative
costs.
- To avoid cancellation
losses, Bookers are advised to take out appropriate holiday insurance.
4. Alternative
Accommodation
- The Owners and their authorised agents reserve the right to refuse any
booking without stating the reason or to cancel, modify or alter
arrangements made by the Booker.
- In the unlikely event that The
Nook ceases to be available for the period of the booking, all monies paid
shall be refunded to the Booker in full, whereupon all liability of the
property Owner and their authorised agents shall
cease.
5. Ownership of The Nook
- The Owners reserve the
right, in view of past experience of breakages, to charge the Booker a
refundable security deposit. Where this is the case the Booker is entitled
to request an inventory of contents on arrival and to expect the full
return of their monies providing nothing is broken or damaged at the end
of the stay.
- The Nook is used as holiday
accommodation and is therefore exempt from security of tenure under the
Rent Act.
6. Party Size
- The number of persons using
the holiday accommodation shall not exceed the maximum number stated in
the description of The Nook, namely 3.
- Sub-letting, sharing or
assignment is not permitted.
7. Booker’s
Responsibilities
- The Booker is responsible
for the property during the period of rental and is expected to take
reasonable care of it.
- All equipment, utensils,
etc, must be left clean and tidy at the end of the hire period. In the
unfortunate event of damage or breakage, the Owner of the property or their
authorized agents should be notified. All damages and breakages are the
legal responsibility of the Booker and their replacement cost will be
payable on demand.
- The Booker is expected to
leave The Nook in the same state of cleanliness, general repair and the
order in which it was found. An additional charge may be made if extra
cleaning is required.
8. Services
- The Owners reserve the
right to make a charge for gas and electricity consumed during the period
of the booking where is has reason to believe that excessive use has been
made of those services.
9. Internet Access
- Access to the Internet is
provided at The Nook on an “as is”, “no liability” basis. There are instructions for connecting to
the Internet available within The Nook, which include a Guide to
Troubleshooting;
however, should it not be possible to establish a
satisfactory connection, then the Owners will not be able to assist.
- All use of the Internet at
The Nook is subject to the Terms and Conditions imposed by the Provider, BT
(see http://www2.bt.com/static/i/btretail/panretail/acceptableuse/,
especially Internet Access – Acceptable Use Policy). In particular, you must not use the
Internet to do anything which is illegal, dangerous, infringes copyright,
interferes with other users, or is otherwise offensive, abusive, obscene,
threatening or designed to cause a nuisance.
10. Access
- The Owners or their authorsied agents shall be allowed access to The Nook
at any reasonable time during any holiday occupancy.
11. Losses
- The Owners or their authorised agents cannot accept any liability for any
loss, damage or expenses of any kind sustained by any member of the Booker’s
party in connection with the use of The Nook, whatever the cause may be,
including negligence, except where such loss, damage or additional expense
is the result of proven negligence of the Owners or their authorised agents.
12. Information
Accuracy
- The information contained in
any advertising material concerning The Nook (including any Website
maintained by the Owners or their authorised
agents) is provided in good faith and is believed to be accurate.
- However, if the Owners
discover errors in material created by its authorised
agents, they will request that alterations be made and will endeavour to
advise the Booker accordingly.
- If the alterations prove
unacceptable to the Booker, then the Booker may cancel the booking and
receive a refund of all monies paid.
13. Complaints
Procedure
- On rare occasions
something may go wrong. The contract is between the Booker and the Owners,
so if any problems do arise during your stay you should contact the Owners
or their authorised agents (whichever was used
to make the booking) immediately. If the matter is not resolved by the
agents, then the Owners should be advised as soon as possible. Complaints
not reported at the time cannot be entertained subsequently and it is
regretted that no correspondence can be entered into in the case of
complaints made after Bookers have returned home when it will be
appreciated that it is quite impossible for them to be effectively
investigated.
14. Warranties
- The Owners and their authorised agents do not warrant and are in no way
responsible for the accuracy of any spoken information given or statements
made by its servants or agents.
15. Legal
- The Owners and their authorised agents cannot accept liability for
happenings outside their reasonable control, such as the breakdown of
domestic appliances, plumbing, wiring, temporary infestation of pests,
damage resulting from exceptional weather conditions, or Booker’s
negligence resulting in loss, injury or accident.
